TERMS AND CONDITIONS OF SALE

1. Acceptance of Terms

By placing an order through the Frueh Building Systems, Inc. website, the customer agrees to these Terms and Conditions.

Frueh Building Systems, Inc. expressly rejects any additional or conflicting terms proposed by the customer unless agreed to in writing.

2. Orders and Payment

All orders must be paid in full at the time of purchase unless otherwise agreed to in writing by Frueh Building Systems, Inc.

Prices, product availability, specifications, and shipping rates are subject to change without notice.

Frueh Building Systems, Inc. reserves the right to cancel or refuse any order for any reason, including pricing errors, inventory discrepancies, suspected fraud, or payment authorization issues.

3. Shipping and Delivery

Shipping and delivery dates are estimates only and are not guaranteed.

Frueh Building Systems, Inc. is not responsible for delays caused by carriers, weather, supply chain disruptions, labor shortages, material shortages, or events beyond our reasonable control.

Customers are responsible for inspecting shipments upon delivery. Any visible freight damage or shortages must be noted with the carrier at the time of delivery.

4. Claims and Shortages

Claims regarding damaged, defective, missing, or incorrect products must be submitted in writing within five (5) business days of delivery.

Failure to provide timely notice constitutes acceptance of the products.

5. Returns and Exchanges

Products may not be returned without prior authorization from Frueh Building Systems, Inc.

Custom, special-order, modified, clearance, or discontinued products are non-returnable and non-refundable.

Approved returns may be subject to restocking fees and must be returned unused, uninstalled, and in original packaging.

Shipping charges are non-refundable unless otherwise required by law.

6. Product Installation and Use

Customers are solely responsible for proper product selection, installation, use, and compliance with all applicable building codes, engineering requirements, safety standards, and accepted construction practices.

Products must be installed in accordance with applicable local building codes and accepted construction practices. The customer and/or installer is responsible for determining product suitability for the intended application.

Frueh Building Systems, Inc. is not liable for damages resulting from improper installation, misuse, neglect, alteration, or unauthorized modifications.

Professional installation is recommended where applicable.

7. Limited Warranty

Frueh Building Systems, Inc. warrants its products against manufacturing defects under normal use.

Except as expressly stated, all products are provided “as is” without warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose.

Frueh Building Systems, Inc.’s sole obligation and the customer’s exclusive remedy shall be limited to repair, replacement, or refund of the original purchase price, at Frueh Building Systems, Inc.’s discretion.

8. Limitation of Liability

Frueh Building Systems, Inc. shall not be liable for any indirect, incidental, consequential, special, punitive, or lost profit damages arising from the purchase, installation, or use of its products.

In all cases, Frueh Building Systems, Inc.’s total liability shall not exceed the purchase price of the product giving rise to the claim.

9. Force Majeure

Frueh Building Systems, Inc. shall not be liable for delays or failure to perform resulting from causes beyond its reasonable control, including but not limited to natural disasters, transportation delays, labor disputes, material shortages, governmental actions, pandemics, or supplier interruptions.

10. Governing Law

These Terms and Conditions are governed by the laws of the State of Wisconsin, without regard to conflict of law principles.

Any disputes arising from purchases made through this website shall be resolved exclusively in the state or federal courts located in Wisconsin.
